A proposed Texas law would alleviate the punishment for minors convicted of sexting from a felony to a misdemeanor. Sexting is a phenomenon whereby an individual sends sexually explicit messages or pictures to his or her friends or significant others. With the increase in cell phone use, sexting seems to be on the rise amongst teenagers.
Currently, under Texas law, anyone who sends a sexually explicit photograph of a minor could be charged with trafficking of child pornography or felony possession. The current consequences for sexting are serious because lawmakers believe harsh penalties will deter minors from engaging in this sort of behavior.
The proposed law would reduce the charge from a felony to a misdemeanor punishable by probation and limited cell phone use. Proponents of the law claim it will be more effective in combating sexting because the judge will be able to order convicted minors to participate in educational programs. The educational programs would focus on the social and personal harm sexting can cause. Additionally, it will help minors understand the long term consequences of their actions.

I don’t think it’s naked political calculus that’s driving Obama. I made an argument yesterday that HCR, whatever form it evolves into, will be the flagship of Obama’s legacy. It directly addresses the largest unfulfilled portion of the progressive agenda as formulated a century ago. It also frames the debate about HC such that it can no longer be avoided by fallacies…the so called free market has produced health care that consumes an unsustainable 20% or more of GNP.
